For 2011 EB2 without spillover
China: August'2006 and India: May'2006
Monthly ~250 allocation is not good enough to cover pending cases prior to May 2006. prior to May'2006 no.of pending cases are close to 2700 cases, so this year quota is good enough to clear these pending cases. With porting we may also see Unavailable down the time.
This leaves for 2006 pending cases
China - 2950
India - 11800 . total ~15K
If we get spill over of 14K then EB2 India & China will move to 2007. Do we get 14K spillover for current year is Big ?

I exported PERM 2008 and PERM 2009 files in excel, then removed the denied and withdrawn cases from those files. Next, I used some filters to find out the exact numbers. Here is what I get:
October 2007 to September 2008
Certified cases: India-7197 and China-1210
Certified-Expired cases: India- 9371 and China-2118
October 2008 to September 2009
Certified cases: India- 6403 and China - 1090
Certified-Expired: India-4984 and China-1022
Spill Over Analysis:
for this we need to consider EB1, Eb2 and Eb5 Quota which is 90K+
EB1 Pending at the beging ofthe year: 7595
Eb2 Row Pending: 8859
Eb5 Pending: 23
Eb2 India & China Quota will be utilized fully : 5600
Total 22,077 so 90K-22K = 68K available for 2011 for categories. EB1, EB5 & ROW EB2
Spill Over Estimate is 68K - EB1, EB5 & Row EB2 estimate. this estimate is diff task & Key.
Pls share if any one able to throw light on this???????

Hi..
i am currently on my 8th year h1..and on the bench..hoping some projects will come thru in a week or so.
Currently i have been on LOP for almost 5 weeks now..
what do you think would be a good option for me:
a.) Start the process for H4..and find a new job..and transfer H1 and stay till H1 is valid till may 2010..
b.) Be on bench for few more weeks.. and hope someting will work out...(firm has said they wont cancel my h1/140).. they are just being helpful..but?
c.) R2I ASAP...and try for a consular processing....?
d.) go to H4...and R2I in May...then if the Eb2(Dec 2005) dates are current..try for a CP..its a long shot...
i am confused..any suggestions??

I am trying to find health insurance for my spouse who is in H4 visa.
Could you please let me know if I can buy the health insurance only for her? Is there some law which states H1B visa holder also needs to buy the health insurance along with the spouse?
BTW, I am living in NJ.

In a recent decision, RUIZ-DIAZ v. UNITED STATES OF AMERICA, the court ruled that Petitioners who filed or will file a Petition for Special Immigrant Religious Worker Visa (Form I-360) with United States Citizenship and Immigration Services (�USCIS�) on behalf of individual beneficiaries are hereby notified that you or your beneficiary may now file an Application for Adjustment of Status (Form I-485) and, if your beneficiary seeks employment status as an adjustment applicant, an Application for Employment Authorization (Form I-765) even if USCIS has not yet issued a final administrative decision regarding the I- 360 petition. Previously, the I-360 had to be adjudicated before the adjustment package could be filed.
The Court has invalidated USCIS� bar against concurrent filings as an unreasonable
interpretation of the governing statute. I am currently working on OPT. My company has just applied for my H1B visa. Assuming it gets approved in 2-3 months time (i.e. in March), when can i have it stamped? Can i go back to my home country to get it stamped in April or will i have to wait till 1st Oct 2011 to get it stamped?

thats what I did when I moved back to company A. My lawyer suggested as long as company A did not cancel your H1 approval you are good to go!!..Hope this helps. Good luck.

If there is a sufficient amount of visas in a category to supply the demand then that category is considered �current� but when the demand over-exceeds the allotted supply of visas the category is considered �oversubscribed.� This is when a visa cut-off date is established, the cut-off date is the �priority date of the first documentarily qualified applicant would could not be accommodated for a visa number.�

I am on l2 since my husband is on L1. I work full time for a US employer with an EAD. Now, what would happen to my status if my husband quits his job? you have EAD, that EAD was entirely based on your L2 status. If L2 status is gone so EAD is invalid too....

Yes, If you have enough Money, Usally 8,000-10,000 $ in the bank statement( This is checked for covering any Medical Bills etc when they are here, just to make sure that the sponser is able to take care of all these when they are in US), That would be enough for you to sponser them.
