Hello,
I am on h1b visa (approved & stamped) and its expiring this Oct'10 (I-94 also expiring in Oct) and due for an extension but here's my problem.
Company A filed my petition in a wrong way in 2007 by showing the job title as "mechanical engineering position" though i was working as Analyst in IT. So if company A files my extension now how likely are my chances of getting my extension approved? as there was no amendment submitted by A for a change in my job title. The below are my options so would really appreciate if you all can suggest and share your thoughts?
1. Go for a H1B extension from Company A itself and if RFE/Denied, can i then proceed with a H1B transfer from Company B? Confused here in figuring out that if my extension is denied will i loose my status and am i eligible to file a new petition as a transfer from Company B?
2. Or directly go for a H1B transfer from a new Company B, this way will i have lesser risk in getting rejected?

Agreed, but look at last week's two leading finalist shots. Basically a couple of good family snapshots: the kid getting wet and a guy with a hose. Confuses me as to what's considered good "competition" photography.

You can get your EB3 PD. Your lawer needs to write to the USCIS to port your PD. Attorney here would give you more details and wait for them to respond.
The OP cannot port his EB-3 PD in this case as his EB-3 I-140 was not filed/approved. One can only port an older PD if they have an approved I-140 with old PD. Just an approved LC with old PD won't help.

This morning I saw a commercial (California Group Blames Immigrants for Climate Change) (http://www.triplepundit.com/2009/11/california-group-blames-immigrants-for-climate-change/)on the local Bay Area channel and was simply surprised, I mean out of words surprised.
I cannot believe how low these anti-immigrant groups can and will go to push their point, which obviously is nothing but full of BS, but it certainly adds fuel to the fire.

IT market is very bad outside and you may be better off taking the position. Hang on to whatever you have for atleast a year and then think about moving. Few of my friends who were recently let go are having a hard time finding anything or the rates are very low. Other people can chime in with their experience...

All i know is that as of yesterday there were only 18000 applications for Masters quota.
Why did not they get filled as fast as the Regular quota?
This is the reasoning my lawyer gave....
"Most of the applicants for Master's quota were in confusion after April 3 after reading several bulletins about 200,000 or so H1-B applications. And some people didn't even apply thinking that the USCIS may have received more than enough master's quota applications even though the bulletin said that they were accepting more applications for Master's quota."
I know of people who have submitted fresh H1-B applications under master's quota as late as April 7th.
So guys, wait for the official numbers. Don't believe me. But do compare when the official news is released.
I am surprised by the slow pace of Master's applications.

Ok. That makes sense. I will contact the HQ and try to find out the solution. Calling the local SS office doesn't help as the first thing their automated system asks for is SS# for you to move on!

I havn't gotten mine yet. Filed on Sept 11th at VSC. Check seems to have cleared though -according to the Attorney. However I guess the delay in my case is the exception rather than the rule.

Do you all think it is just a co incidense that all the dates became current just when this bill (which was supposed to be in grave :rolleyes: ) is revived by those who extremely opposed it?
Do you know how many people will stop giving a damn, because they just filed their 485 s?
People like me who are result of bad practice employers are still here, and lucky ones will depart.....
We have been dealt a crucial blow here.
No one can stop it.

hello, I am in a F1 status for about 3 years, I have been working and filing taxes. I am going to get married to a USC and apply for a green card through it. I want to know if I can have any problem in the aplication since I've been working without authorization. Second in concern to the affidavit support how much should I show and who has to fill these forms since my future wife is unemployed. Third in case my wife file for bankruptcy in the future that could affect me and if it does how can avoid this. By the way I live in florida.

I was working for company A and got my labor and I-140 approved and then i changed to company B. My priority date is jan 2005. Is there any way that i can continue my green card process with company A. WOuld be of great help if somone can tell me if there is any way to do it.

--This should not be a problem, since the H1-B is a dual-intent visa
2. Is H1-B extension based on I-140 possible when not in US?
--Yes. Moreover, if you are in India for a year or more, your 6-year clock starts again.
